You do not have to suffer violence from a partner - the Civil Law is able to provide immediate protection. You may be able to obtain a Court order (Injunction) to prevent a spouse or partner, or former spouse or partner, from being violent towards you, threatening violence or harassing you.
In certain circumstances we are able to obtain an Injunction on the same day if there is evidence to suggest that you are in real imminent danger of serious injury.
It may also be possible for the Court to attach a Power of Arrest to an Injunction Order. This would mean that your spouse or partner, or former spouse or partner, is liable to be arrested if they break the terms of the Injunction Order. If a person is arrested under a Power of Arrest, they will be detained in custody until they can be bought before a Judge. Breaching an Injunction is contempt of Court for which a person can be committed to prison for a maximum of 2 years or be fined.
It is possible to obtain an Injunction Order without the necessity of obtaining a divorce or obtaining any orders about any children in the relationship (unless necessary). An Injunction Order may offer respite whilst you decide what actions you want to take.
